Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and WombTo18 Integrated Care Private Limited ("WombTo18," "we," "us," or "our"), governing your access to and use of our website, mobile applications, and connected Services (collectively, the "Platform").
By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Platform.
Eligibility
- You must be at least 18 years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872, to register as an account holder.
- Where you register on behalf of a child or another individual under your care, you represent and warrant that you are the parent, lawful guardian, or otherwise legally authorised to act on that individual's behalf and to provide consent for processing their data.
- Healthcare providers, schools, and Business Partners accessing the Platform under a partnership or white-label arrangement must possess valid registration, licences, or authorisations required under applicable law for their respective professions or institutions.
- We reserve the right to refuse registration or terminate access where eligibility cannot be verified or is found to be misrepresented.
Account Creation
- You must provide accurate, current, and complete information during registration and promptly update any changes.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
- You must notify us immediately at info@wombto18.com upon becoming aware of any unauthorised access to or use of your account.
- WombTo18 is not liable for any loss or damage arising from your failure to safeguard your account credentials.
- Accounts created through a partner hospital, clinic, doctor, or school (white-label registration) remain subject to these Terms in addition to any terms specific to that partner relationship communicated to you at registration.
User Responsibilities
As a user of the Platform, you agree to:
- Provide true, accurate, and complete information, including health, pregnancy, and child-related data, recognising that reminder and tracking features depend on the accuracy of information you provide.
- Use the Platform only for its intended purpose: preventive health tracking, reminders, care coordination, and related wellness information.
- Not misrepresent your identity, relationship to a child, or professional credentials (in the case of healthcare providers).
- Not upload unlawful, defamatory, infringing, obscene, or otherwise objectionable content.
- Not attempt to gain unauthorised access to other users' accounts, data, or any part of the Platform's infrastructure.
- Not use automated means (bots, scrapers) to access or extract data from the Platform without our prior written consent.
Platform Usage Rules
- The Platform is intended for use by parents, guardians, healthcare providers, schools, and authorised Business Partners for preventive health tracking, reminders, and care coordination.
- Features and modules may be added, modified, or discontinued at our discretion, with reasonable notice where the change materially affects core functionality.
- Access to certain features (e.g., premium tracking, white-label branding, school dashboards) may be subject to additional terms, subscription, or partnership agreements.

WombTo18 is a preventive health information, tracking, and care-coordination platform. It is not a substitute for professional medical advice, diagnosis, or treatment, and does not provide emergency medical care. Vaccination schedules, growth benchmarks, and developmental milestones are based on published guidelines such as those of the Indian Academy of Pediatrics (IAP) and are provided for general informational and reminder purposes only. Always seek the advice of a qualified physician or healthcare provider regarding any medical condition or before making health-related decisions. In the event of a medical emergency, immediately contact emergency services or visit the nearest hospital. WombTo18 does not provide, and shall not be deemed to provide, medical advice, diagnosis, or treatment through the Platform.
Appointment and Service Limitations
- Where the Platform facilitates appointment scheduling, reminders, or coordination with a healthcare provider, school, or vaccination centre, WombTo18 acts solely as a technology intermediary and is not responsible for the availability, quality, conduct, or outcome of services rendered by such third parties.
- Reminder notifications (SMS, WhatsApp, email, push) are sent on a best-efforts basis and are subject to delivery success by telecom operators, messaging platforms, and email service providers, which is outside our control. WombTo18 is not liable for missed reminders due to delivery failure, network issues, or incorrect contact information provided by the user.
- Users remain solely responsible for tracking and attending actual medical appointments and vaccination schedules; the Platform is a supportive tool and does not replace independent diligence.
Digital Information Accuracy Disclaimer
- Health information, vaccination schedules, and developmental milestone content provided on the Platform are sourced from recognised guidelines and are updated periodically, but WombTo18 does not warrant that such information is complete, current, or free from error at all times.
- Information entered by users, healthcare providers, or schools is not independently verified by WombTo18 unless explicitly stated, and WombTo18 is not liable for inaccuracies arising from data entered by third parties.
Intellectual Property Rights
- All content, trademarks, logos, software, design elements, and underlying technology of the Platform are the exclusive property of WombTo18 Integrated Care Private Limited or its licensors, protected under applicable Indian intellectual property laws, including patent application no. 202641073797.
- You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for its intended personal or institutional purpose.
- You may not copy, reproduce, modify, distribute, reverse-engineer, or create derivative works from any part of the Platform without our prior written consent.
User-Generated Content
- Where you upload content to the Platform, including health records, photographs, documents, or feedback ("User Content"), you retain ownership of such content.
- You grant WombTo18 a limited, royalty-free licence to store, process, and display User Content solely for the purpose of providing the Services to you and, where applicable, to healthcare providers or schools you have authorised to view it.
- You represent that you have the necessary rights and consents to upload any User Content, including consent to upload another individual's (including a child's) health information where you are their parent or lawful guardian.
- We reserve the right to remove User Content that violates these Terms or applicable law.
Payments and Subscriptions
- Certain features of the Platform may require payment of a one-time fee or recurring subscription, as specified at the time of purchase.
- Payments are processed through approved third-party payment gateways. We do not store your full payment card details.
- Subscription fees, where applicable, will be clearly disclosed prior to payment, including billing frequency and renewal terms.
- Prices are subject to change with reasonable prior notice; changes will not affect a billing cycle already paid for.
Refund Policy
- Refunds, where applicable, are governed by our Refund Policy, available at www.wombto18.com/refund-policy, which is incorporated into these Terms by reference.
- As a general principle, fees paid for services already rendered (including completed registration, activated tracking, or delivered reminders) are non-refundable. However, in cases of duplicate payment, proven non-delivery of a paid service, or as required under the Consumer Protection (E-Commerce) Rules, 2020, a refund or service credit will be considered on a case-by-case basis.
- Refund requests must be submitted within 7 days of the transaction to info@wombto18.com with supporting transaction details.
Suspension and Termination
- We reserve the right to suspend or terminate your access to the Platform, with or without notice, where you violate these Terms, provide false information, misuse the Platform, or where required to comply with law or protect the safety of other users.
- You may terminate your account at any time by submitting a request through your account settings or to info@wombto18.com, subject to our Data Retention Policy under the Privacy Policy.
- Termination does not affect any rights or obligations accrued prior to termination, including payment obligations.
Limitation of Liability
⚠ Limitation of Liability
To the maximum extent permitted under applicable law, WombTo18's aggregate liability arising out of or relating to your use of the Platform, whether in contract, tort, or otherwise, shall not exceed the total amount of fees paid by you to WombTo18 in the twelve (12) months preceding the event giving rise to the claim, or INR 5,000, whichever is higher. WombTo18 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal injury, arising from your use of or inability to use the Platform, reliance on information provided through it, or any third-party content, service, or conduct.
Indemnity
You agree to indemnify, defend, and hold harmless WombTo18 Integrated Care Private Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your violation of any applicable law; (c) your provision of inaccurate, false, or misleading information; (d) any User Content uploaded by you; or (e) your infringement of any third-party right, including data protection or intellectual property rights.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Dispute Resolution
- In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Platform, the parties shall first attempt to resolve the matter through good-faith negotiation by writing to info@wombto18.com.
- If the dispute is not resolved within 30 days of written notice, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual consent, seated in Pune, Maharashtra, and conducted in English.
- Subject to the above, the courts at Pune, Maharashtra shall have exclusive jurisdiction over any matters not subject to arbitration, including interim relief.
Force Majeure
WombTo18 shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemics, government action, internet or telecommunications failures, power outages, or failures of third-party service providers (including SMS, WhatsApp, or email delivery infrastructure).
Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated through a prominent notice on the Platform or via registered email/SMS/WhatsApp at least 7 days prior to taking effect, except where immediate changes are required for legal or security reasons. Continued use of the Platform after such notice constitutes your acceptance of the revised Terms.
